Adoption in a Wiewpoint of the Czech Legal System and the International Treaties (Critical Comparative Study)

The presented master thesis deals with the issue of adoption of a child, both from the viewpoint of international treaties, as well as the Czech law. The attention is paid to the comparison between the relevant provisions in the Civil Code and the rules contained in the international treaties. Also the way in which the Czech republic reflected the requirements imposed by international treaties is evaluated. The thesis contains an introduction; it is further divided into six chapters and ended with conclusion. First chapter is dedicated to the concept of adoption and the perception under the effective legislation. This chapter also enumerates the particular international treaties, which deal with the adoption and lay down the fundamental requirements for national regulations of the State parties. The second chapter defines the types of adoption including the brief characteristics and description of the main dissimilarities. Due to a certain controversy, the matter of revocation (annulment) of adoption and irrevocable adoption is discussed in more detail. The third chapter introduces the general conditions for the realization of adoption. The issue of international adoption of children is a more discussed theme in the world than it is in the Czech Republic. The presented bachelor thesis introduces the theoretical knowledge from the process of international adoption in the Czech Republic. At the same time, the legislative regulation of this institute is described, where the most important international legal document is the Convention on the Protection of Children and Cooperation in International Adoption, is described here, The brief description defines the issue of international adoption. The aim of this part of the bachelor thesis is to acquaint the reader with the basic facts in the process of international adoption from the Czech Republic and to the Czech Republic. The research part highlights the issue of international adoption through the eyes of a staff member of the Office for International Adoption located in Brno compared to the view of the employee of the Children's Center of the South Bohemian Region, o.p. The Office for International Adoption is the only institution in the Czech Republic dealing with the agenda of international adoption. The Children's Center is in the contact with a child who is placed in the device and is selected for international adoption. The methodological part consists of qualitative research, which was realized through the use of the interview with instructions. Through it, problems were identified in the process of international adoption from the point of view of the workers dealing in this issue. It has been found that the process of international adoption is not perceived as problematic, but the individual steps leading to adoption are. The determination of when the child is adoptable is considered the biggest problem. Children often lack the necessary documentation such as an individual child protection plan or important work with family. The overall process of international adoption is perceived as a very well-set system. This bachelor's thesis can serve as an integral structured description of international adoption. Through its research it can provide valuable advice for expanding this issue.
